Practical Counsel for Management Decisions
Employment law often involves decisions that have to be made in real time.
Management may need to address performance, misconduct, workplace conflict, compensation, leave, a complaint, an investigation, or the end of an employment relationship while continuing to operate the business and manage the rest of the workforce.
My role is not simply to identify every legal risk that could exist. I try to help management understand which issues matter, what options are available, what documentation is important, and what course of action makes sense in light of both the law and the circumstances.
The earlier those issues are identified, the more opportunity a business usually has to address them deliberately rather than react after a problem has escalated.
When to Involve Counsel
Legal advice is often most useful before an important employment decision has been finalized or a workplace problem has become more difficult to manage.
- Before making a significant hiring, discipline, compensation, or separation decision.
- When drafting or materially revising an employment agreement, handbook, or workplace policy.
- When an employee raises a complaint or allegation that may require investigation.
- When management is addressing performance, misconduct, leave, accommodation, classification, or wage-and-hour concerns.
- When confidential information, intellectual property, or other business protections may be affected by an employee's departure.
- When a workplace dispute or internal concern begins to create broader legal, operational, or management risk.
- When an employment issue involves more than one jurisdiction or requires coordination with counsel in another state.
Involving counsel earlier does not mean turning routine management into a legal exercise. It creates an opportunity to identify significant issues, document important decisions appropriately, and address problems while management still has meaningful options.
